These Terms of Service (“Terms”) govern your access to and use of the ATime web application and related pages operated by TimeFliesBy (“we”, “us”) at the site where these Terms are posted (“Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
ATime is a browser-based tool for recording and analyzing watch-related timing information. Features may change; we may suspend or discontinue all or part of the Service with or without notice.
The Service is offered without user accounts. You do not create an account, register, or sign in to use ATime, and we do not provide a way to create accounts.
Important: Your watches, measurements, photos, and other data are stored only locally in this browser using technologies such as IndexedDB and related browser storage (“local storage”). We do not offer cloud backup or sync; your operational data is not uploaded to our servers for storage as part of the Service.
You are solely responsible for any copies of information you keep outside the Service.

The Service may incorporate open-source or third-party software. Such components are licensed on their own terms; those terms apply only to those components and do not grant you rights in the Service as a whole.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW IN THE UNITED STATES, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
ATime is a measurement aid, not a certified timing instrument. Do not rely on it for safety-critical, legal, or professional decisions where certified accuracy is required.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW IN THE UNITED STATES, NEITHER TimeFliesBy NOR ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING LOSS OF DATA DUE TO BROWSER STORAGE CLEARING, DEVICE FAILURE, OR USER ERROR, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ZERO DOLLARS ($0), BECAUSE THE SERVICE IS PROVIDED FREE OF CHARGE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT ALLOWED BY LAW.
You will defend, indemnify, and hold harmless TimeFliesBy and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service or violation of these Terms, to the extent permitted by law.
We may modify these Terms by posting an updated version with a new “Last updated” date. Continued use after changes become effective constitutes acceptance of the revised Terms, to the extent allowed by law.
These Terms are governed by the laws of the United States, excluding conflict-of-law rules. Courts located in the State of Illinois shall have exclusive jurisdiction over disputes, except where consumer protection law requires otherwise.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual action in small claims court or seek injunctive relief in a court of competent jurisdiction in the State of Illinois.
